Terms of Service

Terms of Service

[Business/Program Name] — Online Personal Training & Nutrition Coaching

1. Who This Agreement Is Between

These Terms of Service (“Terms”) form an agreement between Business (“we”, “us”, “our”) and the individual purchasing or using our online personal training and nutrition coaching services (“you”, “the Client”). By creating an account, submitting the Getting Started questionnaire, or making payment, you agree to be bound by these Terms.

2. Nature of the Service

We provide online personal training and general nutrition coaching. This service is intended to support general fitness, nutrition habits, and wellbeing.

This service:

  • Is not medical advice, diagnosis, or treatment of any kind.
  • Does not assess, diagnose, or claim to reduce the risk of any medical condition, including but not limited to dementia or cognitive decline.
  • Is not a substitute for advice from your doctor, an Accredited Practising Dietitian (APD), or any other qualified health professional.

You should consult your doctor before beginning any new exercise or nutrition program, particularly if you have an existing medical condition, are pregnant or breastfeeding, or are otherwise unsure of your fitness to participate.

3. Eligibility and Screening

To participate in this program, you must:

  • Be 16 years of age or older.
  • Complete the Getting Started questionnaire, including all health screening questions, honestly and to the best of your knowledge.
  • Not present with any condition listed in our current contraindications list (provided separately/at signup), which requires referral to an Accredited Practising Dietitian rather than participation in this program.

We reserve the right to decline, pause, or terminate a client’s participation at any time if we reasonably believe continuing would be unsafe, including where screening information provided was inaccurate or incomplete.

4. Assumption of Risk

Exercise and changes to diet carry inherent risk. By participating, you acknowledge that:

  • You are voluntarily participating in physical activity and nutrition coaching at your own risk.
  • You are responsible for exercising within your own physical limits and stopping any activity that causes pain, dizziness, or discomfort.
  • You will seek immediate medical attention for any symptoms that may indicate a medical emergency.

5. Membership, Fees and Billing

Coaching is offered on a subscription basis at the tier selected at signup ([Foundations / Full Support / Concierge], or as otherwise agreed). Fees are charged [monthly, in advance] via [payment provider].

  • [Insert price change notice period, e.g. “We will give at least 30 days’ notice of any change to fees.”]
  • [Insert failed payment / account suspension policy]

6. Cancellation and Refunds

[Insert cooling-off period if applicable under Australian Consumer Law for the sale method used.]

7. Changing or Pausing Your Plan

You may request to change tiers or pause your coaching at any time by contacting us. Changes take effect from [the next billing cycle / a date to be agreed].

8. Your Data and Privacy

We collect personal information, including health-related information you provide during screening and ongoing check-ins, in order to deliver this coaching service. This information is handled in accordance with our Privacy Policy, which forms part of these Terms.

If your circumstances change and you transition to a family care coordination account within our broader platform, information you have provided may carry across to support that transition, with your consent.

9. Communication and Support

[Insert expected response times / channels for check-ins per tier, e.g. “Full Support members can expect a response to messages within 2 business days.”]

10. Limitation of Liability

This clause requires legal review for your jurisdiction and business structure. A generic starting point:

To the maximum extent permitted by law, we exclude all liability for any injury, loss, or damage arising from your participation in this program, except where such liability cannot be excluded under the Australian Consumer Law or other applicable law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded.

11. Termination

We may suspend or terminate your access to coaching services if you breach these Terms, provide false information during screening, or if continuing to provide services would pose a safety risk. You may terminate your membership at any time in accordance with Section 6.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by [email / in-app notice], and continued use of the service after such notice constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of [State/Territory], Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that jurisdiction.

14. Contact
